HOW THE HOLIDAY CAME TO BE

A homemade holiday, still run from one page.

A Facebook page in the day's name began posting in March 2019, announcing May 8 and asking followers to share it so the day could reach a holiday calendar. Two years later the same page credited the idea to the poster's own children, and it is still posting. No founder is named in any citable record.

INTRO

The rulebooks that decide what one cupcake is

Hand a child a cupcake and federal school nutrition rules have nothing to say about it. Ask for a quarter, or even suggest a donation, and the same cupcake counts as a school fundraiser.

National Give Someone a Cupcake Day sits on the free side of that line. The Smart Snacks standards reach only food that is available for sale to students on campus during the school day, so nothing in them follows a cupcake that costs nothing.

The gap is written down rather than overlooked. Texas lists food given to students beside food brought from home, in its own list of exceptions to the standards. A cupcake handed over stays outside them.

Give Someone a Cupcake Day history

INTRODUCTION

In August 2014 a USDA under secretary sat down to correct the record. Several media reports had misrepresented how the new school snack standards would land on fundraisers like bake sales. Kevin Concannon published a piece headed Setting the Record Straight, which said plainly that the department was imposing no federal restriction on them.

Something real had changed that July. The Smart Snacks standards now covered food sold anywhere on a school campus while the school day ran, and school attorneys in New York wrote the whole problem up under the headline Contraband cupcakes. Cupcakes were among the snacks that would not clear the limits.

CHAPTER 01

The door the rule left open

The regulation never closed it. A school may run an infrequent school-sponsored fundraiser that sells food failing the standards, under a special exemption written into 7 CFR 210.11.

The catch is who counts the days. Such fundraisers may not happen more often than the frequency the State agency specifies, which makes the number of non-compliant bake sales a school may hold a state decision rather than a federal one.

CHAPTER 02

The office had the same argument

Two years later the question arrived at work, from dentists. The Royal College of Surgeons of England warned in June 2016 that the workplace had become the main place many adults eat sugar, and put a figure beside it: 64,984 adults were treated in hospital for tooth decay in 2014 to 2015.

The release was careful about what it was asking for. It did not call for a ban on the treats. It called for a change in culture, which is a harder thing to arrange than a rule.

CHAPTER 03

A page that asked to be a holiday

Then, in March 2019, a Facebook page appeared with the day's name on it. Its earliest retrieved post announced May 8 and described the whole idea as a random cupcake surprise. The next post asked followers to like and share so the day could reach a holiday calendar.

It spent that spring campaigning, posting through other national days and noting in April that it was trying to become a recognised day. In May 2021 the page finally said where it had come from, in one line. It credited the idea to the poster's own children.

RULES

A cupcake that costs nothing is nobody's competitive food.

According to USDA research, more than half of all schools did not hold fundraisers selling sweet or salty foods even before the standards arrived. What changed in 2014 was what a school could sell, not what anyone could give away.

Under 21 CFR 101.9, a product packaged and sold individually that holds less than 200 percent of its reference amount must be labelled as one serving. A cupcake arrives having already been counted.

The professional advice was to put cake on a schedule

The Faculty of Dental Surgery's January 2017 position statement offered five tips, one of which was a sugar schedule: birthdays on Monday, Tuesday and Thursday become one cake at Friday lunchtime. Another simply asked people to reduce portion sizes.

Managers want to reward staff for their efforts, colleagues want to celebrate special occasions, and workers want to bring back a gift from their holidays.

Six days in Texas, thirty in Georgia

The Texas Department of Agriculture lets a campus run up to six fundraiser days a school year that ignore the nutrition standards. Georgia's State Board approved 30 exempted fundraisers per school per year, each capped at three days.

In the cake rules, the worked example is a cupcake

The FDA files cupcakes under mediumweight cakes, reference amount 80 grams, and the label instruction for that row offers the cupcake as its worked example. Heavyweight cakes sit at 125 grams and lightweight at 55.

For these rules the school day starts at midnight

7 CFR 210.11 defines the school day as the period from the midnight before until 30 minutes after the official day ends. The school campus is everywhere on school property a student can reach in that window.

One Illinois district sends cupcakes home

Auburn CUSD 10 allows only individually, commercially wrapped food to be handed out, citing food safety and allergies, and tells families plainly: cupcakes, cakes and doughnuts will be sent back home.

The page behind the day had 92 likes

When the Internet Archive captured it on 8 May 2022, the day's own Facebook page showed 92 people liking it and 107 talking about it.

Buying counts, and the page behind the day said so in its earliest retrieved post. It described the point as a random cupcake surprise, not a baking test.

DELIVER

Deliver them rather than wait to be visited

The page reported making and delivering about 80 cupcakes one year, to neighbours, friends and family. Plan a short route and knock on the doors.

GIVE

Give one to somebody who is working

The day's page lists teachers and neighbours among the year's recipients, alongside the obvious family and friends. Pick a person whose day you cross and who is expecting nothing.
